1.1 These terms and conditions apply to all orders which are placed on www.treetopbranding.com for any digital marketing services offered by parent company Tree Top Branding Limited.
1.2 If you create an account with www.treetopbranding.com or agree to use any of our marketing services or you accept a quote from us, then that signifies that you agree to be bound by the terms and conditions in this document.
1.3 Your agreement and business relationship is with Tree Top Branding Limited for the duration of your digital marketing project, which includes any ongoing work.
1.4 All quotations provided by www.treetopbranding.com must be signed off on in writing and all accepted subject to our right to adjust prices due to an increase in wages, taxations or any other changes which may occur to our product costs.
1.5 All quotations are only valid for 30 days and must be agreed within this time frame, or another quotation might have to be set.
2.1 Unless it has been otherwise agreed, all fees for any projects or quotations agreed with www.treetopbranding.com are due in full and in advance of any work commencing.
2.2 We do not offer credit terms, and all invoices are payable upon receipt.
2.3 Payments are made via online bank transfer and all payments are made securely.
2.4 If a client has an objection to any of the information within the invoice then this must be raised within 48 hours of the invoice being received.

3.1 All work completed by www.treetopbranding.com is done off a brief which is submitted by the client and then discussed and agreed with a member of the team.
3.2 All customers need to create their own personal account on www.treetopbranding.com.
3.3 If other work is required which has not been agreed in the additional brief then this must be discussed with your project manager and it will come with additional costs.
3.4 Clients are responsible with supplying the team at www.treetopbranding.com with all the materials and information that they will need in order to effectively execute the project.
3.5 We request that all materials and necessary assets are supplied up front and in advance. We will not be held responsible for any delays to any projects which have been caused by the client not providing the correct information.
3.6 We reserve the right to refuse any materials which we may deem offensive, abusive or indecent at our own discretion.
3.7 The project start date is from when the funds have cleared in our bank account.
3.8 Estimates dates for delivery can not be guaranteed for specific projects such as websites – we will always try our best to meet these deadlines but we will not be held responsible for instances where a project may be delayed for reasons beyond our control.
3.9 For all ongoing project work the customer will determine the duration of the project at the time of submitting the brief and agreeing the final quote. Works will not exceed this timeline unless it has otherwise been previously agreed.
3.10 After the delivery of websites we will offer a reasonable amount of bug fixing and support in cases where this is needed, but any other or larger changes or extra requests will incur additional costs.
4.1 This agreement may be terminated by either party at either time by providing written notice within a reasonable time frame.
4.2 Upon cancellation of a project, www.treetopbranding.com reserves the right to invoice for all of the work which has been completed up until this time.
5.1 Any requests for refunds must be made at the time of receiving the finished product or within good notice of any ongoing projects.
5.2 Refund requests must be made in writing and within this time frame in order to be accepted.
5.3 Tree Top Branding will always endeavour to respond and rectify any issues which arise in any complaints that are made.
6.1 Tree Top Branding warrants and represents to the client that it will perform its obligations under these Terms with reasonable skill and care. Our liability for loss or damage suffered by you in respect of goods or work carried out shall be limited to the contract value of the goods.
6.2 In respect of websites being taken down in the event of overdue accounts, we accept no responsibility for damages (indirect or direct, loss of profits, revenue or goodwill of the client) and any claim will be void. Nothing in these terms and conditions shall affect the rights of the consumer.
7.1 We reserve the right to make changes to these terms and conditions at any time and without prior warning.
7.2 All clients are advised to check back to this page regularly to ensure that they are familiar with the latest version of these terms and conditions.
8.1 Tree Top Branding represents and warrants to the client that it has the experience and the ability to perform the digital marketing services which it offers on the website www.treetopbranding.com.
8.2 These services will be performed in a professional, competent and timely manner and its performance of these services under these terms shall not infringe upon or violate the rights of any third party group or applicable legislation.
8.3 The client represents and warrants to www.treetopbranding.com that it has the power to enter into an agreement with the company, and that its performance under these terms shall not infringe upon or violate the rights of any third party or violate applicable legislation.
9.1 The client shall defend, indemnify and hold harmless Tree Top Branding Limited and its employees, agents and subcontractors from all liabilities, claims and expenses, including all reasonable legal fees that may arise or result from:
- Any service provided or performed or agreed to be performed or any product sold by the client, its agents, employees or assigns.
- Any injury to person or property caused by any products or services sold or otherwise distributed in connection with Tree Top Branding Limited.
- Any material supplied by the client that infringes on the proprietary rights of a third party.
- The client’s use of electronic commerce.
- Any defective product which the client has provided via the services.
